Please read these Terms and Conditions carefully before using FitIt – Weight Loss at Home ("FitIt", "We", "Us", or "Our"). By downloading or using the App, you agree to be bound by these Terms. If you do not agree with these Terms, you must not use the App.

 

1. Introduction

 

FitIt – Weight Loss at Home develops and provides a mobile fitness application (the "App") for general fitness, wellness, and informational purposes.

The App is available for download through the Apple App Store and Google Play Store. These Terms and Conditions ("Terms") govern your use of the App and any related services provided by FitIt.

You should consult a qualified healthcare professional before starting a new exercise or fitness program, particularly if you have any health conditions, injuries, or other concerns that may affect your ability to exercise safely.

By using the App, you acknowledge that you are responsible for determining whether the workouts and activities offered through FitIt are appropriate for you.

 

2. Acceptance of Terms

 

By downloading, accessing, or using FitIt, you accept these Terms in full. If you do not agree to these Terms, you may not use the App.

We may update or amend these Terms from time to time. The most current version will be made available through our official website or within the App. Any changes will become effective when posted, unless otherwise required by applicable law. By continuing to use FitIt after updated Terms become effective, you agree to the updated Terms.

 

3. Eligibility

 

You must be at least 13 years old to use FitIt. If you are under the age of 18, you should obtain permission from a parent or legal guardian before using the App.

FitIt may be available to users in different countries and regions. You are responsible for ensuring that your use of the App complies with the laws applicable in your location.

 

4. Subscriptions and Payments

 

FitIt may offer premium subscription options, including monthly, annual, or other subscription periods made available within the App.

Payment is charged to your Apple App Store or Google Play Store account when your purchase is confirmed, subject to the terms and policies of the applicable platform.

Subscriptions may automatically renew unless auto-renewal is turned off through your Apple App Store or Google Play Store subscription settings before the applicable renewal date.

If FitIt offers a free trial, you must cancel the subscription before the trial period ends if you do not wish to be charged for the subscription, subject to the terms displayed at the time of purchase.

Subscription prices, billing periods, renewal terms, and available offers will be displayed to you before you complete a purchase.

 

5. Refunds and Cancellations

 

Purchases made through the Apple App Store or Google Play Store are processed by the respective platform. Refund requests are generally handled according to the refund policies and procedures of Apple or Google, as applicable.

FitIt does not directly process payments made through those app stores.

To cancel a subscription, you must manage your subscription through your Apple App Store or Google Play Store account settings before the applicable renewal date.

Cancelling a subscription generally prevents future renewals but does not automatically provide a refund for unused portions of an active subscription period, subject to applicable law and the policies of the relevant app store.

 

6. Acceptable Use

 

By using FitIt, you agree to use the App only for lawful and personal purposes. You agree not to:

• Copy, modify, distribute, or reverse engineer any part of the App except where permitted by applicable law
• Use the App for any unlawful, fraudulent, or harmful purpose
• Infringe upon the intellectual property rights of FitIt or any third party
• Attempt to gain unauthorized access to the App, its systems, or related services
• Resell, sublicense, or commercially exploit access to the App without authorization
• Use automated systems or tools to improperly access, collect, or extract data from the App

You are responsible for your use of the App and for complying with these Terms. We may suspend or terminate access to FitIt if we reasonably believe that you have violated these Terms or used the App in an unlawful or harmful manner.

 

7. Health and Safety Disclaimer

The workouts, exercises, fitness plans, and other content provided through FitIt are intended for general fitness and informational purposes only. They are not medical advice and are not intended to diagnose, treat, cure, or prevent any disease or medical condition.

Before starting a new exercise program, consult a qualified healthcare professional, particularly if you have a medical condition, injury, physical limitation, or other health concern, or if you are pregnant.

Exercise involves inherent risks. By choosing to participate in workouts or exercises provided through FitIt, you acknowledge and voluntarily accept the risks associated with physical activity.

Stop exercising and seek appropriate professional advice if you experience pain, dizziness, difficulty breathing, or other concerning symptoms while using the App.

FitIt does not guarantee any specific fitness, weight loss, health, or body transformation results. Individual results may vary depending on many factors, including consistency, lifestyle, and individual circumstances.

 

8. Intellectual Property

 

All content available through FitIt, including but not limited to workout content, exercise demonstrations, videos, GIFs, animations, fitness plans, text, graphics, logos, icons, software, and other materials ("Content"), is owned by or licensed to FitIt and is protected by applicable copyright, trademark, and intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App and its Content for your personal, non-commercial use, subject to these Terms.

You may not reproduce, distribute, modify, publicly display, commercially exploit, or create derivative works from the App or its Content without prior written permission, except where expressly permitted by applicable law.

 

9. Disclaimer of Warranties

 

FitIt is provided on an "as is" and "as available" basis. To the fullest extent permitted by applicable law, we make no warranties or representations, whether express, implied, or statutory, regarding the App or its Content.

We do not guarantee that the App will always be available, uninterrupted, secure, error-free, or compatible with every device or operating system.

We do not guarantee that any user will achieve specific fitness, weight loss, health, or body transformation results through the use of FitIt.

We reserve the right to modify, update, suspend, or discontinue the App or any feature at any time, subject to applicable law.

 

10. Limitation of Liability

 

To the fullest extent permitted by applicable law, FitIt and its owners, developers, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of, or inability to use, the App.

This includes, where permitted by law, losses or damages arising from:

• Your access to or inability to access the App
• Errors, interruptions, or technical issues affecting the App
• Third-party content, services, information, or conduct
• Personal injury, property damage, or other loss arising from participation in physical activity
• Unauthorized access to or use of the App or related systems
• Damage to your device, software, or data

To the fullest extent permitted by applicable law, our total liability for any claim arising from or relating to your use of FitIt will not exceed the amount you paid for FitIt during the 12 months preceding the event giving rise to the claim.

Some jurisdictions do not allow certain exclusions or limitations of liability, so some of the limitations above may not apply to you.
